- PUBLC HEARING: 4 East 77th Street (Between Fifth and Madison Avenues) - This application on behalf of East 77th Flats Realty, LLC (the "Applicant') seeks to reinstate a previous expired use district exception pursuant to Section 11-411 of the Zoning Resolution of the City of New York (the "zoning Resolution" or the "ZR"), which permitted a commercial art gallery in the Subject Property, which is in an R10/Special Parks Improvement district and a R8B/Special Limited Height -- 1A district, pursuant to BSA Cal. No. 96-00 BZ. As required by Section 1.07.3(b)(3) of the Board of Standards and Appeals' ("BSA" or the "Board") Rules of Practice and Procedure (the Board's Rules"), this application is filed on the Special Order Calendar because the use district exception expired more than two years ago, but less than ten years ago.
